Cases for Indians abroad

Running a Ghaziabad case from Dubai or Abu Dhabi

Where the power of attorney is signed since the outsourcing centres closed, what the court here needs from you, and which treaties India has with the UAE.

Power of attorney
Signed in person before the consular officer at the Embassy of India, Abu Dhabi or the Consulate General of India, Dubai. BLS International and SGIVS stopped handling it on 1 July 2026.
Apostille
None. The UAE is not a party to the Hague Apostille Convention.
Money decrees
The UAE is a reciprocating territory under Section 44A CPC, the DIFC and ADGM Courts included.
Clock
The UAE is 1 hour 30 minutes behind India: a 10:00 listing in Ghaziabad is 08:30 in Dubai and Abu Dhabi.

Most Ghaziabad cases can be run from Dubai or Abu Dhabi: a relative holds your power of attorney, the advocate appears on the dates, and the court hears you by video when your own word is needed. What is particular to the UAE is where the power of attorney is signed since 1 July 2026, the absence of an apostille, and which treaties India has with the UAE. The chamber practises Indian law at Ghaziabad; UAE law questions go to a lawyer licensed in the UAE. The general steps are on the page for Indians abroad.

The power of attorney after 1 July 2026

Sign it in person before the consular officer at the Embassy of India in Abu Dhabi or the Consulate General of India in Dubai. By a public notice dated 10 July 2026 the Embassy announced that BLS International and SGIVS Global ceased to be its service providers in the UAE from 1 July 2026; attestation is now done directly at the two missions, on appointments booked only at book.passportindiauae.com. Booking is free; no third party may charge for it.

Under the Embassy's guidelines you bring the original and a duplicate, both signed in the officer's presence; your original passport, with copies of its first five pages and of the page carrying your current residence visa; and a recent passport-size photograph fixed on the front page. Personal presence is compulsory. The two missions differ on access: the Consulate in Dubai takes no walk-ins, while the Embassy in Abu Dhabi keeps a limited walk-in window from 9:00 to 11:00, with newborn and Emergency Certificate cases first.

It is also the shorter route. The UAE is not a party to the Hague Apostille Convention, so a document signed before a UAE notary cannot be apostilled; it needs attestation by the UAE Ministry of Foreign Affairs and then by the Embassy or the Consulate. Signing before the Indian Consul skips both steps. The chamber sends you the draft before your appointment, limited to the case or the property it is for.

When it reaches Ghaziabad

Get it stamped within three months of the day it first arrives in India. Section 18 of the Indian Stamp Act gives a document executed only outside India that period, if need be by taking it to the Collector. After three months the proviso to Section 32 stops the Collector certifying the duty, and the document is impounded under Section 33 with a penalty. Keep the courier receipt; it fixes when the period began.

At the sub-registrar, Section 33(1)(c) of the Registration Act accepts a power of attorney from a principal living outside India if it was executed before and authenticated by an Indian Consul or Vice-Consul, among others, and Section 33(4) lets it be proved by simply producing it. In court, Section 84 BSA (old Section 85 Evidence Act) makes the judge presume that such a document was so executed and authenticated.

Mutual divorce in Ghaziabad while you stay in the UAE

You give consent from the UAE on video while your attorney handles the filing and the dates. In Amardeep Singh v. Harveen Kaur, (2017) 8 SCC 746, para 22, the Supreme Court said the court can use video conferencing and permit genuine representation through close relations such as parents or siblings. In Ankit Agrawal v. Smt. Monika Agrawal, 2025:AHC:9349, the Allahabad High Court set aside a Firozabad Family Court order refusing a husband abroad, who had filed through his attorney, leave to appear electronically, and directed that he be heard by video.

The 2026 rules for video hearings in the district courts of Uttar Pradesh let a civil case be heard by video and, for a person overseas, name an official of the Indian Embassy or Consulate as the coordinator at the remote end: for you, the Embassy in Abu Dhabi or the Consulate in Dubai. Family Courts are not named in the operative rules, so the chamber asks for the video statement in the petition itself, citing both judgments. Some judges still want one appearance in person.

The six-month wait can be waived under Amardeep Singh only where the six months and the one year of separation are over before the first motion, mediation has failed, alimony, custody and every other issue are settled, and waiting would only prolong the agony. The Family Court at Ghaziabad grants it rarely, so plan for the full six months. The NRI mutual divorce page sets out the petition.

If the divorce is in a Dubai or Abu Dhabi court instead

Whether India accepts a UAE divorce depends on the tests in Y. Narasimha Rao v. Y. Venkata Lakshmi, (1991) 3 SCC 451. Abu Dhabi's civil family court for non-Muslim foreigners, under Abu Dhabi Law No. 14 of 2021, grants divorce on one spouse's wish without a reason (Articles 6 and 7) unless a party asks for the law of his own country (Article 3). In Shilpa Sachdev v. Anand Sachdev (Family Court Appeal No. 56 of 2016, 11 August 2017) the Bombay High Court held an ex parte Dubai divorce of a Hindu couple not conclusive: the Dubai court lacked competence over the wife, and its ground was not one the Hindu Marriage Act recognises. See whether a Dubai divorce is valid in India.

Court papers sent to a UAE address

A summons in a Ghaziabad divorce or civil suit cannot go to the UAE through the Hague Service Convention, because the UAE is not a party to it; the court directs in each case how a respondent in the UAE is served. India's Mutual Legal Assistance Treaty with the UAE (2000) is criminal: it provides for service of documents, with the Ministry of Home Affairs as nodal ministry, under Section 110 BNSS (old Section 105 CrPC).

For maintenance under Section 144 BNSS (old Section 125 CrPC) against a husband in the UAE, no ruling found settles the channel. The BNSS treats an electronic summons as duly served (Sections 63 and 70(3)), and a respondent wilfully avoiding service faces an ex parte order under Section 145 BNSS (old Section 126 CrPC), which can be set aside for good cause within three months.

Money judgments of UAE courts

A UAE money decree can be executed in Ghaziabad as if the District Court had passed it. By G.S.R. 38(E) dated 17 January 2020 the UAE is a reciprocating territory under Section 44A CPC; the notified courts include the federal courts, the Abu Dhabi Judicial Department, Dubai Courts, the Ras Al Khaimah Judicial Department, and the ADGM and DIFC Courts. The decree-holder files a certified copy with the UAE court's certificate of satisfaction; execution is refused if a Section 13 CPC exception is shown. Only decrees for a sum of money qualify: not taxes, fines or penalties, never an arbitration award, and not a divorce.

A criminal case in Ghaziabad while you are in the UAE

High Courts have repeatedly held that a Look Out Circular is not meant for routine matrimonial cases under Section 85 BNS (old Section 498A IPC); in 2026 the Karnataka and Andhra Pradesh High Courts said police were opening them mechanically. Anticipatory bail under Section 482 BNSS (old Section 438 CrPC) from abroad is unsettled: the Allahabad High Court granted it on conditions to an applicant in Canada in a Ghaziabad case (Ankit Kakkar v. State of U.P., 2026:AHC:196969), and the Gujarat High Court refused, on the merits as well, an applicant who affirmed his petition in Dubai (Ankur Gopalbhai Patel v. State of Gujarat, 2 February 2026). See Look Out Circulars and anticipatory bail for NRIs.

Property in Ghaziabad from the UAE

Rule 24 of the Foreign Exchange Management (Non-debt Instruments) Rules, 2019 lets an NRI or OCI buy any immovable property other than agricultural land, plantation property or a farm house, and inherit any property; those three can be transferred only to a person resident in India. Payment comes through banking channels or an NRE, FCNR(B) or NRO account. A power of attorney to sell, and its UP stamp duty, is explained on ghaziabadregistration.com. Tax on a sale is for a chartered accountant.

Starting from Dubai or Abu Dhabi

Send scans of your passport, residence visa and the marriage or property papers on WhatsApp to +91 98710 27648. The chamber says which court has the case and drafts the power of attorney before you book the mission appointment. A 14:00 listing in Ghaziabad is 12:30 in the UAE. The page for Indians abroad covers the common steps; the Singapore page shows where the treaties differ.

Questions people ask

Can I still get a power of attorney for India attested at BLS or SGIVS in Dubai?

No. From 1 July 2026 BLS International and SGIVS Global no longer act for the Indian missions in the UAE. Attestation is done directly at the Embassy of India in Abu Dhabi and the Consulate General of India in Dubai, on an appointment booked free at book.passportindiauae.com. You attend in person with your original passport, a photograph, and copies of your passport and residence visa.

Can I use a UAE notary and an apostille instead?

There is no apostille for the UAE, because the UAE is not a party to the Hague Apostille Convention. A document signed before a UAE notary has to be attested by the UAE Ministry of Foreign Affairs and then by the Indian Embassy or Consulate. Signing the power of attorney before the Indian consular officer avoids both steps, and that is the route the chamber drafts for.

How long do I have to stamp the power of attorney after it reaches India?

Three months from the day it is first received in India, under Section 18 of the Indian Stamp Act. After that the Collector can no longer certify the duty under Section 32, and the document is impounded with a penalty. Courier it as soon as it is signed, keep the receipt, and send a scan to the chamber so that stamping is arranged in time.

Can a Dubai court money judgment be executed against someone in Ghaziabad?

Yes, if it is a money decree of a notified UAE superior court. Under a notification dated 17 January 2020 the UAE is a reciprocating territory for Section 44A CPC, and the list includes Dubai Courts, the Abu Dhabi Judicial Department and the DIFC and ADGM Courts. The District Court refuses execution if a Section 13 CPC exception is shown, and arbitration awards are excluded.

Do I have to fly to Ghaziabad for a mutual consent divorce?

Not for most of it. Your attorney files and attends, and the Family Court can hear your consent by video, as the Supreme Court allowed in Amardeep Singh and the Allahabad High Court directed in Ankit Agrawal. The 2026 Uttar Pradesh rules name an Indian Embassy or Consulate official as the coordinator for a person overseas. Some judges still ask for one appearance in person.
