Up to 7 years: ask about the notice
For offences punishable with up to 7 years, police should first issue a notice to appear instead of arresting. Comply with it in writing. BNSS 35(3)
If arrested: the 24-hour rule
The arrested person must be told the grounds of arrest, a relative must be informed, and the person must be produced before a Magistrate within 24 hours. BNSS 47, 48, 58

How do I get anticipatory bail in Ghaziabad?
File an anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which replaced Section 438 CrPC, before the Sessions Court at the District Court, Raj Nagar District Centre (RDC), Ghaziabad. If it is refused, the next forum is the Allahabad High Court. For offences punishable with up to 7 years, police must generally issue a notice under Section 35(3) BNSS instead of arresting (Arnesh Kumar v. State of Bihar, 2014).
How long does a mutual consent divorce take in Ghaziabad?
Under Section 13B of the Hindu Marriage Act, the couple must have lived separately for at least one year before filing a joint petition in the Family Court, Ghaziabad. The second motion is normally heard 6 months after the first. Under Amardeep Singh v. Harveen Kaur, (2017) 8 SCC 746, the court can waive the 6-month wait if the couple has been separated for over 18 months, mediation has failed, and alimony, custody and all other issues are settled.
What are the deadlines in a Section 138 cheque bounce case?
The payee must send a written demand notice within 30 days of receiving the bank's return memo. The drawer then has 15 days from receiving the notice to pay. If the drawer does not pay, the complaint must be filed within the next 1 month. Section 138 of the Negotiable Instruments Act provides up to 2 years' imprisonment, a fine of up to twice the cheque amount, or both. Section 143A allows interim compensation of up to 20% of the cheque amount.
How do I get an FIR quashed in Ghaziabad?
FIRs registered in Ghaziabad are quashed by the Allahabad High Court through a petition under Section 528 BNSS, which replaced Section 482 CrPC. The High Court quashes an FIR when the allegations, taken as true, disclose no offence, are absurd, or are made with malice, following State of Haryana v. Bhajan Lal (1992). Matrimonial and other private disputes can also be quashed after a genuine settlement between the parties.
My bank account was frozen by the cyber police. What can I do?
Police can freeze an account under Section 106 BNSS, which replaced Section 102 CrPC. First get the freeze details from your bank: the police station or cyber cell and the complaint number. Then apply to that cyber cell for release. If the account stays frozen, apply to the jurisdictional Magistrate for release of the amount, or approach the High Court where the freeze is disproportionate to the disputed amount.
