A marriage solemnised in Ghaziabad, a flat in Indirapuram or an FIR at a district police station stays here when you move to Dubai or Singapore, but much of what the court or office needs from you can be scanned, signed at an Indian mission or given by video.
Divorce by consent from abroad
A mutual consent divorce under Section 13B of the Hindu Marriage Act can run in the Family Court, Ghaziabad while you live abroad: a relative holding your power of attorney files and attends, and you give your consent statement by video when the court permits. Amardeep Singh v. Harveen Kaur, (2017) 8 SCC 746, lets the court use video and allow representation through parents or siblings; plan for the full six months between the two motions. NRI mutual consent divorce from abroad sets out each step.
Divorce when your spouse will not agree
You can file a contested petition in the Family Court, Ghaziabad if Section 19 of the Hindu Marriage Act points here: the marriage was solemnised here, your spouse lives here, or the two of you last lived together here. A spouse living in Ghaziabad can also file here against a spouse who lives outside India, and a wife can always file where she lives. NRI contested divorce covers the rest, and the where-to-file tool works out which court a petition can go to.
A divorce from Dubai, Abu Dhabi or Singapore
Indian law gives effect to a foreign divorce of a Hindu Marriage Act marriage only if the foreign court's jurisdiction and the ground it granted on fit that Act, or your spouse lived where the case was filed and the ground is one the Act allows, or took part and contested on such a ground, or consented to the divorce. That is the test in Y. Narasimha Rao v. Y. Venkata Lakshmi, (1991) 3 SCC 451, and the Consulate General of India in Dubai says on its passport page that it needs a declaratory order from an Indian civil court before it acts on a foreign divorce. Divorced in Dubai, married in India explains that order.
An FIR, a Look Out Circular and anticipatory bail
What stops a traveller at immigration is a Look Out Circular, opened at the investigating agency's request, and High Courts have repeatedly held that it is not meant for routine matrimonial cases such as one under Section 85 BNS (old Section 498A IPC). Anticipatory bail under Section 482 BNSS (old Section 438 CrPC) can be sought from abroad; the Allahabad High Court has granted it on conditions, but the Supreme Court has not settled the point and courts expect you to return and cooperate. FIR, Look Out Circular and anticipatory bail for NRIs sets out the steps before you fly.
What differs between the UAE and Singapore
The UAE is not an apostille country, so a power of attorney or affidavit for India is signed in person before the consular officer at the Embassy of India, Abu Dhabi or the Consulate General, Dubai. Since 1 July 2026 they give these services directly, on free appointments from book.passportindiauae.com. A Ghaziabad case from Dubai or Abu Dhabi has the details.
Singapore has been an apostille country since 16 September 2021, so a document apostilled there needs no further attestation by an Indian mission. Papers in a civil case can be served in Singapore under the Hague Service Convention, which the UAE has not joined. A Ghaziabad case from Singapore has the details.
Property and the power of attorney
A relative in Ghaziabad can sell, buy, register or manage property for you on a power of attorney signed before an Indian consular officer, or apostilled in Singapore, and stamped in India within three months of its arrival. It does not itself pass title: under Suraj Lamp & Industries v. State of Haryana, (2012) 1 SCC 656, the attorney must sign and register a sale deed. The power of attorney guide on ghaziabadregistration.com covers stamp duty, the sub-registrar and FEMA limits; the property lawyer page covers disputes over title or possession.
Maintenance when one spouse lives abroad
A husband living in Dubai or Singapore does not stop a maintenance case under Section 144 BNSS (old Section 125 CrPC): if he wilfully avoids service, the court can proceed ex parte under Section 145 BNSS (old Section 126 CrPC). Both sides file an affidavit disclosing assets and liabilities under Rajnesh v. Neha, (2021) 2 SCC 324, AIR 2021 SC 569, and maintenance runs from the date of the application, so a salary earned abroad goes on affidavit. Maintenance defence under Section 144 BNSS sets out the husband's side of the same case.
How the chamber runs a file from abroad
Documents. Send scans of the marriage certificate, passports, the FIR or court papers, and title documents on WhatsApp to +91 98710 27648. The chamber tells you which court or office the matter belongs to before any original moves.
The power of attorney. Drafted here for the one case or the one property, signed before the Indian consular officer or a Singapore notary with an apostille, and stamped in India within three months of its arrival under Section 18 of the Indian Stamp Act.
Video appearance. Your statement or evidence is yours to give, not your attorney's. The 2026 rules for the district courts of Uttar Pradesh provide for hearings by video and, for a person overseas, name an official of the Indian Embassy, Consulate or High Commission as the coordinator at your end; whether to allow it is for the judge.
Time zones. At 10:00 in Ghaziabad it is 08:30 in Dubai and Abu Dhabi and 12:30 in Singapore. The application for video states the hours you can be on screen.
Certified copies. The chamber or your attorney applies for certified copies of orders and of the decree. If an office in the UAE or Singapore will rely on an Indian decree, ask it what attestation it needs.

Questions people ask
Can my Ghaziabad case be run without my coming to India?
Much of it can. A relative holding your power of attorney can file papers, attend dates where your presence is not required and collect orders. Your own statement or evidence is given by you, in person or by video when the court permits. Some judges ask for one personal appearance at a deciding hearing; the chamber tells you when that is likely so that you plan one trip, not several.
Will I be stopped at the airport if an FIR is pending in Ghaziabad?
Immigration stops a traveller on a Look Out Circular, which is opened at the request of the investigating agency; the FIR does not create one by itself. High Courts have repeatedly held that a Look Out Circular is not meant for routine matrimonial cases. Before you book a ticket, the chamber reads the FIR and the court record and advises on anticipatory bail under Section 482 BNSS (old Section 438 CrPC).
Who should hold my power of attorney?
A parent, sibling or other relative in or near Ghaziabad who can attend the court or the sub-registrar and keep the originals safe. The deed names the case or the property and lists each act the attorney may do. The attorney cannot give your statement or your evidence. For a sale of property in Uttar Pradesh, the stamp duty on the deed also depends on whether the attorney is a listed family member.
What time is a Ghaziabad hearing where I live?
The courts at Ghaziabad sit on Indian time. The UAE is 1 hour 30 minutes behind India, so a 10:00 hearing in Ghaziabad is 08:30 in Dubai or Abu Dhabi. Singapore is 2 hours 30 minutes ahead, so the same hearing is 12:30 in Singapore. A case can be called at any point in the day's list, so keep the court's morning free on the day you are to appear by video.
Can I start before sending any originals?
Yes. Scans of the marriage certificate, passports, the FIR, court papers or title documents sent on WhatsApp are enough for the chamber to read the matter, say which court or office it belongs to and draft the power of attorney. Originals come later: the signed power of attorney travels to India, and the court or the sub-registrar sees the other originals when it asks for them.
