Running a Ghaziabad case from Singapore

The apostille, the High Commission, service of court papers, and what happens when a divorce is filed in both countries.

Apostille
Available. Singapore has been a party since 16 September 2021 and India since 14 July 2005; an apostilled document needs no further attestation by an Indian mission.
High Commission
Applications on SEWA from 1 September 2026; documents handed in at BLS International until further notice.
Court papers
Served through the Hague Service Convention, in force for Singapore since 1 December 2023.
Clock
Singapore is 2 hours 30 minutes ahead of India: a court day starting at 10:00 in Ghaziabad starts at 12:30 in Singapore.

On paperwork, Singapore is a simple country to run a Ghaziabad case from: a power of attorney can be apostilled, and court papers have a treaty channel. On divorce it is harder, because Indian couples there often end up with a case in each country. Advocate Vishu Kushwaha practises Indian law at Ghaziabad; anything that turns on Singapore law, including a case in a Singapore court, needs a lawyer licensed in Singapore. The page for Indians abroad covers what is common to every country.

Apostille or High Commission attestation

A power of attorney signed in Singapore can be made usable in India either by a Singapore notary followed by an apostille, or by attestation at the High Commission of India. India joined the Hague Apostille Convention with effect from 14 July 2005 and Singapore from 16 September 2021, so the Convention runs between them. The High Commission's own note on apostilles says that once an apostille, including an e-Apostille, has been issued, no further attestation or legalisation by an Indian mission is needed for use in India.

The High Commission route changed on 1 September 2026. Every consular and attestation application now starts on SEWA, the Indian Consular Services System: you upload scans there, then go in person to BLS International, which receives the documents and fee until further notice, with your passport and IC in original and copy. A fresh outsourcing tender was issued on 28 September 2026, so the receiving centre may change; check the High Commission's site for the current provider. Its power of attorney page was not loading when this was checked; confirm the requirements when you book.

Which route suits depends on where the document will be used. Indian law names both a notary and an Indian Consul among the authorities it accepts for a principal living abroad, but whether a power of attorney notarised outside India carries the same presumption in an Indian court is not settled. The chamber tells you which route to book before you sign. A power of attorney to sell a Ghaziabad flat is explained on ghaziabadregistration.com.

Stamp duty and registration in India

The stamp clock starts when the document first lands in India, not when you sign it in Singapore. A document executed only outside India may be stamped within three months of its first receipt here under Section 18 of the Indian Stamp Act, through the Collector where the proper stamp cannot be fixed privately. Past three months, Section 32 no longer lets the Collector endorse the duty, and Section 33 impounding, with a penalty, takes over. Courier it promptly and keep the delivery record.

For a registered sale, an attorney may present the deed under the Registration Act if the power of attorney of a principal living abroad was executed before and authenticated by an authority listed in Section 33(1)(c); under Section 33(4) it is proved by producing it. In a court case, Section 84 BSA (old Section 85 Evidence Act) raises a presumption that a power of attorney appearing to be executed before such an authority was duly executed.

Serving Ghaziabad court papers in Singapore

Papers in a Ghaziabad civil or family case reach a spouse in Singapore through the Hague Service Convention, in force for India since 1 August 2007 and for Singapore since 1 December 2023. It covers civil and commercial matters, a divorce petition included. Criminal papers take another road: India and Singapore signed a Mutual Legal Assistance Treaty in 2005 that covers serving documents, and a Ghaziabad criminal court sends its process through the Ministry of Home Affairs under Section 110 BNSS (old Section 105 CrPC).

When one spouse files in Singapore and the other in Ghaziabad

Both courts can have a case about the same marriage at once. Under Section 93 of the Women's Charter 1961 a Singapore court hears a divorce if either spouse is domiciled in Singapore when the case starts, or has been habitually resident there for the three years immediately before. Section 94 bars a divorce application in the first three years of marriage without the court's permission. The only ground is irretrievable breakdown, proved by one of six facts; since 1 July 2024 one of them, Section 95A(1)(f), is that both spouses agree the marriage has broken down irretrievably. The Charter's divorce provisions do not apply to a marriage solemnised or registered under Muslim law (Section 3).

The Ghaziabad Family Court has its own footing in Section 19 of the Hindu Marriage Act: a wife can file where she lives, and a spouse living here can file here when the other is outside India. Whether the Singapore case should give way is for the Singapore court and a Singapore lawyer. Whether India later accepts a Singapore decree turns on Y. Narasimha Rao v. Y. Venkata Lakshmi, (1991) 3 SCC 451: the forum and the ground must fit the law under which you married, unless the respondent lived in that forum and the ground is one that law also allows, or took part and contested on such a ground, or consented to the decree. What you do in the Singapore case therefore shapes the Indian answer. The page on foreign divorces and Indian recognition sets out the tests.

Children: Singapore is in the Hague Child Abduction Convention, India is not

Singapore has been a party to the 1980 Hague Child Abduction Convention since 1 March 2011; India is not a party, so the Convention's return procedure does not run between the two countries in either direction. When a child is brought from Singapore to India, the Indian court decides on the child's welfare, the Singapore order being one factor. Under Nithya Anand Raghavan v. State (NCT of Delhi), [2017] 7 SCR 281, it may instead order a prompt return in a summary hearing if the case is brought soon after the removal, the child has not put down roots here, and return serves the child's welfare; it may refuse return that would expose the child to grave risk of harm.

The Supreme Court applied that test in Rohith Thammana Gowda v. State of Karnataka (Civil Appeal No. 4987 of 2022, decided 29 July 2022), sending a child born in the USA back to the father there, with the mother free to go along and seek custody in that forum. What a child says it wants and what serves its welfare were treated as separate questions. Where the child stays in Ghaziabad, the case itself runs as set out on the page on child custody in Ghaziabad.

A mutual divorce in Ghaziabad without leaving Singapore

For a couple married under the Hindu Marriage Act, a mutual consent decree from the Ghaziabad Family Court raises no recognition question in India, and the spouse in Singapore can consent on screen. The Supreme Court allowed video conferencing in such cases, and representation by a parent or sibling of a spouse who cannot attend, in Amardeep Singh v. Harveen Kaur, (2017) 8 SCC 746, para 22. The Allahabad High Court, over the Ghaziabad courts, applied it in Ankit Agrawal v. Smt. Monika Agrawal, 2025:AHC:9349, directing a Family Court to hear by video a husband abroad whose attorney had filed the petition.

Under the 2026 Uttar Pradesh district-court rules on electronic and video hearings, the coordinator at the far end for a person overseas is an official of the Indian Embassy, Consulate or High Commission; in Singapore, the High Commission. Those rules do not name Family Courts in their operative part, so the chamber writes the request for a video statement into the petition and supports it with both judgments. A 10:00 listing in Ghaziabad falls at 12:30 in Singapore.

The six-month gap between the motions can be waived only on the Amardeep Singh conditions: eighteen months of separation complete before the first motion, mediation tried and failed, alimony, custody and every other issue truly settled, and nothing to gain from waiting. Ghaziabad's Family Court seldom grants it; plan for the full six months. Whether Singapore treats the Indian decree as ending the marriage for its own purposes is a question for a Singapore lawyer.

Starting from Singapore

Send scans of your passport and IC, the marriage certificate and any papers from either court on WhatsApp to +91 98710 27648. The chamber tells you whether Ghaziabad has jurisdiction, which attestation route fits, and what the court here needs from you. The page for Indians abroad has the common steps, the Dubai and Abu Dhabi page shows where the UAE differs, and criminal complaints are covered under Look Out Circulars and anticipatory bail.

Questions people ask

Does a power of attorney apostilled in Singapore need attestation at the Indian High Commission?

No. India and Singapore are both parties to the Hague Apostille Convention, and the High Commission of India in Singapore states that a document carrying an apostille, including an e-Apostille, needs no further attestation by an Indian mission for use in India. It still has to be stamped in India within three months of first arriving here.

How do I get a document attested at the High Commission of India in Singapore now?

From 1 September 2026 every consular and attestation application starts online on SEWA, the Indian Consular Services System. You upload scans, then hand in the documents and the fee in person at BLS International, which receives them until further notice, with your passport and IC. A fresh outsourcing tender was issued on 28 September 2026, so check the current provider on the High Commission site first.

Can a Ghaziabad divorce case be served on my spouse in Singapore?

Yes. India and Singapore are both parties to the Hague Service Convention, which came into force for Singapore on 1 December 2023 and covers civil matters such as a divorce petition. Criminal papers go through the India-Singapore Mutual Legal Assistance Treaty of 2005, under Section 110 BNSS (old Section 105 CrPC).

Will India accept a divorce granted in Singapore?

It depends on the tests in Y. Narasimha Rao v. Y. Venkata Lakshmi. The Singapore court's jurisdiction and its ground must fit the law you married under, unless the other spouse lived in Singapore and the ground is one Indian law also recognises, or took part and contested on such a ground, or consented. A decree the other spouse never took part in is the one most open to challenge in India.

My spouse brought our child from Singapore to India. Can I use the Hague Convention?

No. Singapore is a party to the 1980 Hague Child Abduction Convention but India is not, so its return procedure does not apply. The Indian court decides on the child's welfare, treating the Singapore order as one factor, and may order a prompt return in a summary hearing if the case is brought soon after the removal and the child has not settled here, as the Supreme Court held in Nithya Anand Raghavan.
