FIR quashing

Quashing a 498A case after settlement: from the Family Court in Ghaziabad to the High Court

The settlement, the mutual consent divorce and the quashing petition are one sequence. Done in the right order, the criminal case ends with the marriage.

The offence
Cruelty by a husband or his relatives, Section 85 BNS (the old Section 498A IPC), usually with Dowry Prohibition Act counts in the same FIR.
Where it is quashed
Allahabad High Court, under Section 528 BNSS, on a settlement that is voluntary and performed.
The sequence
Memorandum of understanding, Section 13B petition at the Family Court, Ghaziabad, first motion, performance, quashing petition.
Where to start
Chamber 817, District Court Complex, Raj Nagar District Centre (RDC), Ghaziabad, Uttar Pradesh 201002. Bring the FIR, the divorce papers and the settlement draft.

Why it is one sequence and not three cases

A Ghaziabad marriage that breaks down with a police complaint rarely produces one case. There is the FIR under Section 85 BNS at a Ghaziabad police station, often with Sections 3 and 4 of the Dowry Prohibition Act added. There is a complaint under the Protection of Women from Domestic Violence Act before the Magistrate. There is a maintenance application under Section 144 BNSS before the Family Court. And there is the marriage itself, which both sides now want ended. The quashing page explains the High Court's power in general; this article is about using it to close the whole matrimonial bundle at once.

The reason it works is the Supreme Court's recognition, in Gian Singh v. State of Punjab, (2012) 10 SCC 303, that a matrimonial dispute is a private one. Once the spouses have settled, a Section 85 BNS trial can only end in an acquittal, because the complainant will not support the case, and keeping it alive serves no one. The court therefore quashes it on the settlement, provided the settlement is real.

Step one: the memorandum of understanding

Everything begins with a written settlement signed by both spouses, and it is the document the chamber spends the most time on. It covers permanent alimony and how it is paid, custody and visitation where there are children, the return of stridhan and jewellery with a list, and the withdrawal of every case between the two families. On the husband's side it must say in terms that the wife will cooperate in the quashing of the FIR and will file her affidavit of no objection; on the wife's side it must fix when each instalment is paid, because her consent to the divorce and to the quashing is the leverage she gives up.

The settlement is drafted so that it can be annexed, unchanged, to three petitions: the Section 13B petition at the Family Court, the withdrawal applications in the Domestic Violence Act and maintenance proceedings, and the quashing petition at Allahabad. One document, consistent across all three courts, is what persuades the High Court that the compromise is genuine.

Step two: the Section 13B petition at the Family Court, Ghaziabad

The spouses file a joint petition for divorce by mutual consent under Section 13B of the Hindu Marriage Act at the Family Court in the District Court complex at RDC, with the settlement annexed. Both appear and their statements on the first motion are recorded. The mutual consent divorce page covers the petition and the two motions, and the cooling-off waiver article explains when the six-month wait between the motions can be waived under Amardeep Singh v. Harveen Kaur, (2017) 8 SCC 746. A pending criminal case that both sides have agreed to close is one of the facts the Family Court weighs when it decides whether there is anything left to reconcile.

The first-motion order, with the statements recorded, is the first piece of court-side proof that the settlement is being acted on. The chamber usually waits for it before filing at Allahabad.

Step three: performing the settlement

The High Court quashes on a settlement that has been performed, not promised. The first instalment of alimony is paid through the bank, the stridhan is returned against a signed receipt, the Domestic Violence Act complaint and the maintenance application are withdrawn by applications that record the settlement, and the withdrawal orders are obtained. Each step produces a paper that goes into the quashing petition. A husband who wants the FIR closed before paying anything is asking the court to take the settlement on trust, and the court will usually adjourn until it does not have to.

Step four: the quashing petition at Allahabad

The petition under Section 528 BNSS is filed by everyone named in the FIR: the husband, his parents, and any sibling or relative the complaint roped in. The State of Uttar Pradesh and the wife are respondents. It annexes the FIR, the charge sheet and the trial court's orders if the case has progressed, the settlement, the Section 13B petition and first-motion order, the proof of performance, the withdrawal orders in the connected cases, and the wife's affidavit of no objection, sworn with her identity proof annexed.

The petition is argued on the compromise ground: the offence is a matrimonial one, the parties have settled and are being divorced by consent, the complainant does not wish to proceed, and continuing the case would be an abuse of process. It does not need to argue that the FIR was false; in a settlement petition that argument is unnecessary and can antagonise the complainant whose cooperation the petition depends on.

The wife's affidavit and her appearance

The complainant wife's affidavit states that the dispute has been settled, that the terms have been performed, that she has sworn the affidavit of her own will, and that she has no objection to the FIR and all proceedings arising from it being quashed. In matrimonial petitions the Allahabad High Court commonly wants her before it, or identified by her own counsel, to confirm this. The chamber fixes the hearing date around her availability, and where she lives abroad, her affidavit is attested at the Indian mission and her appearance is arranged through counsel or by video where the bench permits.

Her affidavit is also the answer to the State's usual objection. The Government Advocate may say the offence is serious; the court looks at the settlement and the complainant's stand and decides whether the dispute is private in character, which a matrimonial dispute between two families almost always is.

The connected dowry and domestic violence cases

The Dowry Prohibition Act counts are quashed with the FIR because they are part of it. The Domestic Violence Act complaint and the Section 144 BNSS maintenance application are before the Ghaziabad courts and are closed there, by withdrawal under the settlement, before the quashing petition is heard; their orders are annexed so the High Court sees that nothing remains. If the wife had also filed a complaint case before the Magistrate on the same facts, that too is withdrawn or made part of the petition. The aim is that the quashing order and the divorce decree between them leave no proceeding alive between the two families.

If arrest is the worry in the meantime

A Section 85 BNS offence carries up to three years, so the police are bound by the notice procedure under Section 35(3) BNSS and Arnesh Kumar v. State of Bihar, (2014) 8 SCC 273, rather than straight arrest. Where the risk is real, anticipatory bail under Section 482 BNSS before the Sessions Court, Ghaziabad protects the family while the settlement is worked out; the stay of arrest article covers that and what the High Court itself grants once the petition is filed.

How the chamber runs it

The chamber handles the settlement drafting, the Section 13B petition and the withdrawals at RDC, and briefs the quashing petition to counsel at Allahabad, so that the three courts see one consistent record. The client sees one sequence with dates rather than three cases pulling in different directions. The overall procedure, the other grounds for quashing and what to bring are on the FIR quashing page.

Questions people ask

Should the quashing petition be filed before or after the divorce decree?

Usually after the first motion in the Section 13B petition has been recorded and the settlement terms have been performed, and often after the decree. The court wants to see that the settlement is real and acted upon. Filing the quashing petition before anything has moved on the divorce side invites an adjournment until it has.

My wife is the complainant. Does she have to come to the High Court?

In a matrimonial quashing the court commonly wants the wife present, or at least identified by her own counsel, to confirm that the settlement is voluntary. Plan on her appearance at Allahabad on the date fixed, with her identity proof and her sworn affidavit of no objection already on record.

The FIR also names my parents and my sister. Are they covered?

They should be, which is why everyone named in the FIR is made a petitioner. A settlement that closes the case against the husband and leaves the in-laws facing trial is not the settlement the court expects, and the memorandum of understanding should say that all proceedings against all family members are being withdrawn.

What happens to the dowry and domestic violence cases?

They go in the same petition, or in connected petitions heard together. The Dowry Prohibition Act counts are usually part of the same FIR. The Domestic Violence Act complaint and the maintenance application under Section 144 BNSS are before the Ghaziabad courts and are withdrawn there under the settlement, with the withdrawal orders annexed to the quashing petition.

Can the wife reopen the case after it is quashed?

The quashing order ends that FIR and the proceedings under it. The settlement terms are recorded in the order, and a fresh complaint on the same facts would face that order. This is one reason the settlement should be complete and performed before the petition is decided, so there is nothing left to fall out over.
